1. Acceptance of Terms

By accessing or using the services of the Australian Institute of Expert Witnesses (AIEW), you agree to be bound by these Terms of Service. If you do not agree to these terms, you should not use our services.

2. Services

AIEW provides the following services:

  • Expert witness referral and engagement coordination
  • Expert report preparation and peer review
  • Technology platform access (Evidence Engine™)
  • Expert accreditation and membership
  • Training and continuing professional development

3. Expert Services

When engaging AIEW for expert services, you acknowledge that:

  • Experts have an overriding duty to the court, not to the engaging party
  • Expert opinions are based on the information provided and may change if new information emerges
  • AIEW facilitates expert engagement but experts are independent professionals
  • Turnaround times are estimates and may vary based on matter complexity

4. Fees and Payment

Fees for expert services are quoted on a per-matter basis and must be paid in accordance with the engagement terms. AIEW reserves the right to require payment in advance or deposits for certain services. Cancellation fees may apply.

5. Confidentiality

All information provided in connection with expert engagements is treated as confidential. AIEW and its experts will not disclose confidential information except as required by law, court order, or with your consent.

6. Intellectual Property

Expert reports prepared for clients become the property of the engaging party upon payment. However, AIEW retains the right to use de-identified data for quality assurance, training, and research purposes. The AIEW name, logo, and technology platform remain the intellectual property of AIEW.

7. Limitation of Liability

To the maximum extent permitted by law, AIEW's liability for any claim arising from our services is limited to the fees paid for the specific service giving rise to the claim. AIEW is not liable for any indirect, consequential, or special damages.

8. Dispute Resolution

Any disputes arising from these terms or our services will be resolved through mediation in the first instance. If mediation is unsuccessful, disputes will be determined by arbitration in accordance with the laws of New South Wales, Australia.

9. Amendments

AIEW may amend these terms from time to time. Continued use of our services after amendments constitutes acceptance of the updated terms.
